1. Instant writ petition under Article 226 of the Constitution of India has been preferred by the petitioner seeking following reliefs :- 10.1 That the Hon'ble Court kindly be pleased to issue a order, directing the respondent No. 4 to take prompt action for demarcation of lands of the petitioner within stipulated period which may be fixed by this Hon'ble Court.
10.2 That, the Hon'ble Court may kindly be pleased to call for the records for its kind perusal which relates to petitioner matter.
10.3 Any other relief, which the Hon'ble Court may deem fit and proper, may also be passed in favour of the petitioner”

Learned counsel appearing for the petitioner submits that the petitioner is recorded owner of the land bearing Khasra No. 40/12, 40/16, 113/1, 139/9, 137/3, 139/8 & 141/3, total area 1.750 hectare situated at village Banbod, Patwari Halka No. 15, Rajashva Nigam Mandal, Mudhipar, Tahsil Khairagarh, District Khairagarh Chhuikhadan Gandai (C.G.). He further submits that that aforesaid land is ancestral property of the petitioner, but various encroachment have been made on said land of petitioner, therefore, he has filed an application (Annexure P-2) dated 26.05.2025 for demarcation of his aforesaid land. The petitioner has also paid requisite fee for the said demarcation, despite that demarcation has not been carried out, therefore, he submits that respondent No. 4- Tahsildar, Khairagarh may be directed to get the above land of the petitioner demarcated.

In reply, learned counsel for the State / respondents, on instructions, submits that demarcation of some portion of the land of the petitioner was carried out on 25.06.2025, but because of rainy season, demarcation work was not completed. Learned counsel for the State submits that if petitioner shall extend his consent, then fresh demarcation of the aforesaid land be carried out.
4. I have heard learned counsel for the parties and perused the material available on record.

Having considered aforesaid contention putforth by counsel for both the parties, this petition stands disposed of directing respondent No. 4 - Tahsildar, Khairagarh, Disrict Khairagarh Chhuikhadan Gandai to take decision on the application (Annexure P-2) dated 26.05.2025 filed by the petitioner and demarcation be carried out within a period of 45 days from the date of receipt / submission of copy this order. The petitioner is further directed to approach before the office of Tahsildar, Khairagarh for unhindered compliance of this order.
6. With the aforesaid observations & directions, the writ petition is disposed of.
7. Pending interlocutory application (s), if any, stand (s) disposed of.
