1. Since both the above captioned appeals arise out of the same impugned award and accident, they are taken up analogously for hearing and are being disposed of by this common order.

MAC No. 1456 of 2018

2. This appeal is filed by the appellants/claimants under Section 173 of the Motor Vehicles Act, 1988 (for short “the Act”) against the award dated 2.5.2017 passed by the Additional Claims Tribunal to the Court of First Additional Motor Accident Claims Tribunal, Dongarhgarh District Rajnandgaon(CG) in Claim Case No.31/2014.

3. By the impugned award, the Tribunal partly allowed the claim petition filed by the claimants under Section 166 of the Act and awarded a total sum of Rs.3,87,000/- by way of compensation to the claimants for the death of deceased -Ramesh Nishad in a vehicular accident.

4. So the question that arises for consideration in this appeal filed by
