The applicant has preferred this First Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 17/2025, registered at Police Station- Mahila Thana - Ambikapur District- Surguja (C.G.) for the offence punishable under Sections 3, 4, 5 and 7 of Immoral Traffic (Prevention) Act, 1956.

As per the prosecution story, it is alleged that the present applicant used to provide customers to the co-accused persons, namely Hemant Das and Jamuna Devi, who were allegedly earning their livelihood illegally by providing rooms in their house for the purpose of prostitution and by allowing boys and girls to use the said rooms. Hence, the present offence.

3. It is argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in this case. He further submitted that the applicant used to provide customers to the co-accused persons named Hemant Das and Jamuna Devi who were illegally earning her livelihood by providing rooms for performing prostitution in their house and providing rooms to boys and girls, however no girl and boy have been arrested or made accused in this case. Further the co-accused person, namely, Subhadra Rai has already been granted bail by this Court vide order dated 11.12.2025 passed in MCRC No. 10225/2025. He also submitted that the applicant has no previous criminal antecedents, the charge-sheet has been filed in this case and the applicant is in jail since 13.12.2025 and trial is likely to take quite long time for its conclusion, therefore, he prays for grant of bail on the ground of parity.

4. On the other hand, the learned State counsel opposes the bail application of the applicant but could not dispute the fact that the co-accused person has already been granted bail by this Court.

5. I have heard learned counsel for the parties and perused all of the documents available on record.

Taking into consideration the facts and circumstances of the case, the nature and gravity of the allegations levelled against the applicant, and the fact that co-accused person, namely, Subhadra Rai has already been granted bail by this Court vide order dated 11.12.2025 passed in MCRC No. 10225/2025. He also submitted that the applicant has no previous criminal antecedents, the charge-sheet has been filed in this case and the applicant is in jail since 13.12.2025, and the conclusion of the trial is likely to take some time, this Court is of the view that the applicant is entitled to be granted regular bail in this case on the ground of parity.

7. Accordingly, the bail application is allowed. Let applicant -

Laxmi Vishwas, respectively involved in Crime No. 17/2025, registered at Police Station- Mahila Thana - Ambikapur District- Surguja (C.G.) for the offence punishable under Sections 3, 4, 5 and 7 of Immoral Traffic (Prevention) Act, 1956, be released on bail on his furnishing a personal bond with two sureties in the like sum to the satisfaction of the Court concerned with the following conditions:-

(i) The applicant shall file an undertaking to the effect that she shall not seek any adjournment on the dates fixed for evidence when the witnesses are present in court. In case of default of this condition,
