1. The petitioners have filed this writ petition seeking following reliefs:-

“10.1 That, this Hon'ble Court may kindly be pleased to set- aside/quash the order dated 20.10.2022 (ANNEXURE P-1) issued by respondent no. 3 (Deputy Director, Veterinary Services Dhamtari, District Dhamtari), whereby rejected the representation of petitioners for grant of regular pay scale along with all arrears in view of the Government circular dated 10.05.1984, in the interest of justice.

10.2 That, this Hon'ble Court may kindly be pleased to direct the respondent authority for consideration to grant of regular pay scale as per the circular dated 10.05.1984 and the consequence to considered and grant arrears of the salary as they have entitled to sought relief in the facts and circumstances of the case, in the interest of justice.

10.3 That, this Hon'ble Court may kindly be pleased to grant any other relief/relief's in favour of the petitioners, which the Hon'ble Court deemed fit & just in the facts and circumstances of the case, including awarding of the costs to the petitioner.”

2. Facts of the case, in a nutshell, are that the petitioners were initially appointed as Part-Time Sweepers on collector rate from the contingency fund in the respondent department. Appointment letters to the petitioners were issued in different years, namely 1997 and 1999. Since the date of their initial engagement, the petitioners have been continuously discharging their duties with the respondent department. Thereafter, the services of the petitioners were regularized and in the year 2007 they were treated against sanctioned posts. Subsequently, in the year 2009, the petitioners were accommodated as full-time workers on the post of Sweeper and were also granted seniority. In view of their long and continuous service, the petitioners were further promoted/adjusted (samayojit) in the regular establishment. It is submitted that initially the petitioners were paid wages at the rates fixed by the Collector. However, there exists a Government Circular issued by the erstwhile State of Madhya Pradesh dated 10.05.1984, which governs the grant of regular pay scale to such employees upon their absorption/regularization. It is further submitted that similarly situated employees, who were absorbed along with the petitioners, were granted the benefit of regular pay scale along with all arrears in terms of the Government Circular dated 10.05.1984, after approaching this Court. One such order granting the said benefit was passed on 09.09.2019. In view of the aforesaid circular and the benefit granted to similarly situated employees, the petitioners also approached this Court by filing a writ petition. The said writ petition was disposed of by order dated 25.03.2022, whereby this Court directed respondent Nos. 2 and 3 to examine the claim of the petitioners under the applicable Government Circulars
