1. In compliance of the Court order dated 25.11.2025, the victim appeared before the Court today, and the learned State Counsel verified her presence. The victim raised an objection to the grant of anticipatory bail to the applicant.
2. This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.178/2025 registered at Police Station – Hasaud District – Sakti (C.G.) for the offences punishable under Sections 137(2), 129, and 65(1) of the BNS and Section 4 of the Protection of Children from Sexual Offences Act.

The prosecution story in brief, is that, victim made written complaint to the police Station and stated therein that on 26-09- 2025 at about 6.00 PM, the prosecutrix went to the market/bazaar with her friend and when they returning from the market/bazaar, the present applicant chased her and in the midway, the applicant closed the mouth of victim and take in the field and committed raped upon her. On the basis of said report, the police has registered the crime as mentioned above against the applicant.
4. The learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in this case. He further submits that the He has neither committed nor participated in any act that may constitute the alleged offences. The false report has been lodged due to an old enmity between the family members of the applicant and the victim. The applicant is a respectable citizen, and his imprisonment would tarnish his image in society and among his family. There is no medical evidence to suggest that any forcible act was committed by him, which further shows that he has been falsely implicated. The applicant is a young student of 20 years, studying in B.A. Second Year, and his arrest would jeopardize his future. He is a well-reputed person in his locality and society, and arrest would adversely affect his image. The applicant undertakes not to tamper with evidence or influence witnesses in any manner. He reserves the right to raise any other grounds and submit relevant documents at the time of hearing. The applicant is willing to furnish adequate surety and shall abide by all directions and conditions imposed by this Hon’ble Court, therefore, the he prays for grant of anticipatory bail to the applicant.
5. Learned State Counsel opposed the bail application and contended that, as per the statement of the prosecutrix recorded under Section 183 of the BNSS, the applicant forcibly established a physical relationship with her. Therefore, the applicant is not entitled to be released on bail.
6. I have heard learned counsel for the parties and perused the case diary.

Considering the facts and circumstances of the case, the submissions advanced by the learned counsel for the parties, the nature of the allegations, and the material available in the case diary, and upon perusal of the statement of the victim recorded under Section 183 of the BNSS on 26.09.2025 at about 6:00 PM, wherein it is stated that the prosecutrix had gone to the market with her friend and while returning, the present applicant chased her and in the midway, the applicant closed the mouth of victim and take in the field and committed raped upon her, having regard to the
