1. The petitioners have filed the present writ petition seeking a direction for grant of enhanced compensation in respect of land bearing Khasra No. 254/9, situated at Village Dheka, Tahsil Bilaspur, District Bilaspur (C.G.), admeasuring 0.028 decimal which has been acquired for the purpose of construction of National Highway.

2. Learned counsel for the petitioners would submit that although the petitioners’ land has been acquired, a proper compensation has not been paid. It is further contended that the petitioners have already preferred a representation before the Commissioner / Sole Arbitrator appointed under Section 3G(5) of the National Highways Act, 1956, however, the same has not been decided till date.

3. In view of the aforesaid submission, since the representation has already been filed by the petitioners, the same is directed to be treated as an application under Section 3G(5) of the National Highways Act, 1956, and the Sole Arbitrator is directed to decide the same within a period of four months from the date of receipt of a copy of this order.

4. The petitioners shall be at liberty to amend the pleadings and place on record all relevant documents in support of their claim. The Sole Arbitrator is directed to decide the matter after issuing proper notice and affording due opportunity of hearing to all concerned parties, in accordance with law.

5. With the aforesaid observations and directions, the writ petition stands disposed of.
