1. Heard Mr. Shubham Dev Mallick, learned counsel for the petitioners. Also heard Mr. Dharmesh Shrivastava, learned Deputy Advocate General for respondent No.1/State and Mr. C. Jayant K. Rao, learned counsel for Respondent No.2.

2. The present CRMP has been filed by the petitioners with the following prayers:

“It is, therefore, prayed that this Hon’ble Court may kindly be pleased to allow this petition and quash the FIR no 0451/2023 & Final Report bearing 0400/2023 for offence under Section 498-A/34 of the Indian Penal Code, registered in PS Civil Line Rampur- Dist- Korba C.g., as well as the entire criminal proceedings pending before the learned court, in the interest of justice.”

3. This Court vide order dated 21/06/2024 referred the matter to the Mediation Centre of this Court for mediation of the dispute and the mediation between the parties have failed.

4. It has been argued by learned counsel for the petitioners that petitioner No.6 is husband of respondent No.2 and their marriage was solemnized in the year 2020. It is further argued that the complainant herself has left the matrimonial house and the husband has filed an application under Section 9 of the Hindu Marriage Act for restitution of conjugal rights on 14/06/2022 before the learned Family Court Korba and thereafter only the present FIR has been lodged. It is further argued that the Petitioner No.1 & 2 are the sister-in-law of the complainant and they are residing separately after their marriage. Therefore, it is prayed that the instant petition may be allowed and the proceedings pending against the petitioners may be quashed.

On the other hand Mr. Dharmesh Shrivastava, learned Deputy Advocate General for the State/Respondent submits that once a complaint is received by the police and prima facie cognizable offence is made out, the police is bound to register the FIR and proceed in accordance with law. As such, the police has registered the FIR, investigated the matter and thereafter filed the charge sheet before the learned trial Court and the trial is pending consideration.

6. On the other hand, learned counsel appearing for respondent No.2 has submitted that the
