1. The applicant has filed this petition assailing non-compliance of the order dated 17.09.2025 passed by this Court in WP(C) No. 4957 of

2025.

2. Learned counsel for the applicant would submit that the Additional cns [kyh Tahsildar, Bilaspur vide memo dated 03.03.2017 has issued Digitally signed by ANGARE Date:

2025.12.19 +0530 okjaV for evicting K.P.S. Arora and to restore Saraswati Sahu and after that Panchnama was prepared on 10.03.2017 to the said effect. The applicant applied for certified copy of the order which has not been provided to him as the original record are not available in the Tahsil Office, Bilaspur, therefore, this contempt petition has been filed.

3. This Court has directed the Tahsildar to provide certified copy.

4. During midst of argument it has been brought on record that the certified copy is available with the petitioner that has been produced before the Civil Court and now certified copy is required in the criminal case and it has been informed that the matter is pending before the Judicial Magistrate First Class.

5. It is made clear that in view of such circumstances, the trial should not be kept in abeyance because of non-availability of the records, therefore, the applicant is directed to move an application before the concerned Judicial Magistrate First Class, Bilaspur to request the learned Civil Judge, Class I to provide records at the time of examination and after perusing the same, the Judicial Magistrate First Class will allow the documents to be exhibited.

6. Let a copy of this order be forwarded to learned District Judge also so that the records may be reached to the Judicial Magistrate without any hindrance.

7. However, since grievance of the petitioner is redressed, the contempt petition is disposed of.

8. The Tahsildar is also directed to conduct an enquiry how record is misplaced and will submit a report before this Court in a sealed envelope within an outer limit of 04 weeks from the date of receipt of copy of this order.

9. Before parting with the case, this Court is constrained to observe that in revenue proceedings whenever disputed issues are raised, the records are missing, therefore, the Secretary, Revenue Department is directed to develop a system for safety of the records or if requires go for scanning the records to maintain in a e-mode so that missing of record is avoided.

10. Accordingly, this Contempt Petition is disposed of.
