1. This writ petition has been filed by the petitioner seeking following reliefs:-

“10.1 That, this Hon’ble court may kindly be pleased to issue appropriate writ by directing the respondents state authority to cancel the tender/proposed liquor shop near about Village Masankuda i.e. bearing Khasra No. 338/5 area 0.2270 hectares, situated at Village Lendra, Block Baramkela, District Sarangarh- Bilaigarh (C.G.).

10.2 That, this Hon’ble Court may kindly be pleased to issued appropriate writ/direction to the respondent no. 2 to decide the pending representation dated 27.11.2025 with objective manner in accordance with law and transfer the composite country made liquor shop from away from Village Masankuda.

10.3 That, this Hon’ble Court may kindly be pleased to issue appropriate writ/direction to the respondents to kept away the opening of liquor shop from the proposed place till the decision of representation dated 27.11.2025. 10.4 That, this Hon’ble Court may kindly be pleased to issue any other suitable writ/orders/directions in favour of the petitioner looking to the facts and circumstances of the case.”

Learned counsel for petitioner submits that respondents have identified the place near to village Masankuda, Village Panchayat - Amoda, District Sarangarh - Bilaigarh (C.G.) for opening of liquor shop which is near to the Anganbadi Public Pond and also to primary school and, therefore, according to the guidelines issued by State Government it is not suitable for opening of liquor shop. Petitioner has already submitted representation Annexure P/1 before the Collector in this regard raising all the grievances on 27.11.2025, however, till date no decision is taken on the representation, hence direction be issued to respondent no. 2/ Collector, to take decision on pending representation within a specified time frame.

3. Learned counsel for State submits that as learned counsel for petitioner is not pressing this writ petition on merits and is only seeking direction to respondent no. 2 to take decision on pending representation, he is having no objection.

4. I have heard learned counsel for the respective parties and perused the documents enclosed along with this writ petition.

5. On due consideration of submission made by learned counsel for the respective parties and also considering representation Annexure P/1 already submitted in the officer of Collector on 27.11.2025, this writ petition at this stage is disposed of directing respondent no. 2/Collector to consider and take decision on pending representation submitted by petitioner, expeditiously, in accordance with law, preferably within a further period of 02 weeks from the date of receipt of copy of this Order, keeping in mind the guidelines issued by State Government in this regard.

6. With the aforesaid observation and direction, writ petition is disposed of.
