1. The present review petition has been filed by the petitioner for reviewing the order dated 06.08.2025 passed by this Court in WPS No. 9118/2025. The review petitioner had filed a Writ Petition (S) No. 9118/2025, challenging the order dated 10.06.2025 issued by respondent No. 2 – Under Secretary, Tribal Welfare Department, Raipur and consequently, for quashing of the entire counseling proceeding being conducted pursuant thereto. The writ petition was also filed for a direction to the respondent authorities to conduct counseling proceeding for Hostel Superintendent (Grade-C) afresh at State level for total 1732 posts including 755 posts on which, teachers are working as incharge Hostel Superintendent (Grade-C). After hearing the parties, the writ petition filed by the review petitioner was dismissed vide order dated 06/08/2025. After considering the entire facts and circumstances of the case as well as in view of the facts that a similar WP(S) No. 5958/2025 (Vijay Kumar Yadu & others Vs. State of C.G. & others) has already been decided vide order dated 02.07.2025 and the issue involved in the WPS No.

9118/2025 were identical to that WPS No. 5958/2025.

2. The brief facts of the writ petition was that the writ petitioner was appointed in the year 2015, to the post of Hostel Superintendent (Grade-D). The writ petitioner was promoted on 09-06-2022 to the post of Hostel Superintendent (Grade-C), and posted at Pre-Matric Scheduled Tribes Boys Hostel, Gopalpur-Rajpur, District Balrampur. Various communications have been made between the Department and the Stats Government on 13-09-2023 and 27-11-2024. The final gradation list was also published on 05-07-2024 with respect to Hostel Superintendent Grade-C, as on 01-04-2024. The respondent No.2 issued an order on 10-06-2025 for conducting counselling of the Hostel Superintendent (Grade-C) for the purposes of their posting. By the order dated 10-06-2025, a three-level committee has been constituted by the State Government for the posting of the promoted Hostel Superintendents. The petitioner made his representation on 20-06-2025 and 21-07-2025 to the respondent No.3, but no action has been taken on the representation till date, Hence, the writ petition was filed.

The review petitioner has filed the review petition claiming for the setting aside the order dated 06.08.2025 passed in WPS No. 9118/2025, setting aside of the promotion orders of the Class-C employees passed in violation of State circular dated 03.06.2025 (Annexure-A/7 and A/11) and also for a direction to the Respondent No. 3 to give posting to the petitioner in non-

scheduled area in State level counseling.

4. Learned counsel for the review petitioner would submit that the petitioner was promoted to the post of Hostel Superintendent (Grade-C) in the year 2022 and he was discharging his duties at Dist- Balrampur Ramanujganj. The next promotional post of Hostel Superintendent (Grade-C) is 100 % promotional posts, however, vide circular dated 03.06.2015, the State
