2. Facts of the case, in a nutshell, are that the petitioner is serving as a Lady Constable/GD in the Central Industrial Security Force (CISF), Unit NTPC Sipat, bearing Force No. 129801221, under the administrative control of the respondent authorities. The petitioner’s grievance arises out of an incident dated 03.08.2019, when at around 7:00 p.m., while she was performing duty at Janjigate, Constable Shailendra Tiwari allegedly passed lewd and objectionable remarks at her. It is stated that the said constable had been repeatedly making such remarks in the past as well, with a clear intention of harassing and molesting the petitioner whenever he found an opportunity. On the following day, i.e., 04.08.2019, he again came to the Janjigate post and, with similar intent, began abusing the petitioner in an indecent manner, attempted to outrage her modesty, and made unbearable and derogatory comments about her character. Finding the situation intolerable and acting in self-defense, the petitioner slapped him. Following the incident, a departmental inquiry committee was constituted; however, according to the petitioner, the inquiry was conducted in a biased and unfair manner, resulting in a one-sided report against her. Based on the said report, the disciplinary authority imposed upon her the punishment of censure under a final order dated 28.07.2022. The petitioner’s appeal against the punishment was rejected by respondent No. 4 on 30.10.2022, and her subsequent revision petition met the same fate, being dismissed as devoid of merit by order dated 24.03.2023. Aggrieved by the rejection of her revision petition and the disciplinary action upheld by the authorities, the petitioner has approached this Court by filing the present petition.
