1. The present appeal has been filed by the plaintiff/appellant under Section 96 of the code of Civil Procedure, 1908 (in short ‘the CPC’) against the impugned judgment and decree dated 30-01-2012 passed by the learned Fourth Additional District Judge Bilaspur in Civil Suit No.33-B/2011 whereby the civil suit filed by the plaintiff has been partly decreed and the decree for recovery of Rs.
