After holding an inquiry, learned trial Court referred the matter to the Juvenile Justice Board, Bilaspur on 29.07.2022. Upon conducting the inquiry, the Juvenile Justice Board, Bilaspur, determined that the appellant was over 18 years of age at the time of the incident and sent the matter back to the concerned trial Court on 10.07.2023. Thereafter, the learned trial Court framed charges against the appellant on 12.07.2023. He further submits that during the inquiry for determination of the appellant’s age, other accused, Abishek Dan and Sahil @ Shibu, had already been facing trial before the trial Court, and P.W.-1 to P.W.-9 had been examined. However, after framing of charges against the present appellant, only P.W.-1 (Asif Mohammad) and P.W.-6 (Sheikh Alam) were examined. The remaining witnesses, namely P.W.-2, P.W.-3, P.W.-4, P.W.-5, P.W.- 7, P.W.-8, and P.W.-9 were not examined after framing of charges.
