1. The applicant has preferred this anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of Anticipatory Bail, apprehending his arrest in connection with Crime No. 231/2025, registered at Police Station – Moudahapara, District – Raipur

2. The case of the prosecution is that the complainant lodged a report alleging that she had been familiar with the applicant/accused since 2020. They were in a love affair with each other, and after some time, the complainant came to know that the applicant had been engaged to another girl. On 23.10.2025, at about 6:30 p.m., when the complainant was alone at her home, the applicant came there and forcibly entered her house. The accused then abused her and physically assaulted her with the intent to outrage her modesty. Upon her report, an offence under Sections 333, 296, 115(2), 74, and 75 of the Bharatiya Nyaya Sanhita (B.N.S.) has been registered against the applicant.

3. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case. He submits the applicant has never been involved in any such offence as alleged against him, and a false case has been foisted upon him. He submits that the applicant and the complainant had prior acquaintance and were in relationship. Taking undue advantage of the applicant’s goodwill, the complainant repeatedly demanded money, which the applicant provided from time to time. At the complainant’s request, the applicant deposited Rs. 16,000/- towards her daughter Rida Fatima’s school fees on 17/10/2025 and 18/10/2025. Further, the applicant transferred Rs. 5,000/- to the victim’s mother, Shayra Bano, on 20/10/2025 Rs. 50,000/-, on 03/07/2025 Rs. 10,000/-, on 08/04/2025; and Rs. 10,000 on 23/03/2025 through UPI. He further submits that during this period, the complainant’s greed increased, and she started demanding excessive amounts, threatening the applicant with false allegations. Upon his refusal to pay further amounts, the victim, with malicious intent, lodged a false and fabricated complaint against the applicant. He also submits that the applicant belongs to a respectable family and is employed as an Executive in Sunrise Virtual Pvt. Ltd. In the event of his arrest by the police, his reputation and social standing would be severely tarnished, and his career would be irreparably damaged, ultimately resulting in the loss of his employment, a loss that he would never be able to compensate for throughout his lifetime. Therefore, he prays for grant of anticipatory bail to the applicant.

4. On the other hand, the learned State counsel opposes the applicant’s submissions and contends that the complainant has known the applicant since 2020 and was in a love relationship with him. She later discovered that he had become engaged to another woman. It is alleged that on 23.10.2025 at about 6:30 p.m., while the complainant was alone at home, the applicant forcibly entered her house, abused her, and physically assaulted her with intent to outrage her modesty, causing abrasions on her neck and face. Hence, the applicant is not entitled to anticipatory bail.
