1. This Writ Petition has been filed against the order dated

07.10.2022 (Annexure P/3) passed by Collector, Balrampur Ramanujganj, Chhattisgarh by which, services of the petitioner as Angan Badi Sahaika has been terminated.

2. The petitioner has prayed for the following reliefs:-

10.1 That this Hon'ble Court may kindly be pleased to quash the impugned letter dated 07.10.2022, Annexure P-3, Issued by the Respondent No.2. And reinstate the service of the petitioner with back wages.

10.2 That this Hon'ble Court may kindly be pleased to grant compensations to petitioner and any other relief(s) as deemed fit and necessary by this Hon'ble Court in the facts and the circumstances of the case.

10.3 That this Hon'ble Court may kindly be pleased to grant cost of present petition.

3. Necessary facts of the case are that the petitioner was initially appointed as a Anganbadi Sahayika in the Anganbadi Centre Samudri, Janpad Panchayat Shankargarh by the order of Chief Executive Officer Janpad Panchayat Shankargarh by the order dated 19/08/2003 and used to work in very sincere manner and honestly till the termination order has been passed. One oral complainant was raised against the petitioner in the program of "Vidhayak Aapke Dwar" that petitioner has not done his work in proper manner and not provided Hot Food and Ready to Eat food, thereafter Project Officer Integrated Child Development Project Shankargarh issued a notice and seeking clarifications on 27/09/2022. That the petitioner submitted her reply against the allegations leveled against her and submitted she has never disobeyed her duty, but due to pressure of "Vidhayak" respondent authorities didn't hear any explanations submitted by the petitioner. That the allegation against the petitioner was not proved and complainant was not present and also not participated in the enquiry but respondent no.2 terminated the service of petitioner as a Anganbadi Sahayika on 07/10/2022 without giving any opportunity of hearing. Hence this petition.

Learned counsel for the petitioner submits that petitioner was working as Angan Badi Sahaika, however, without following the procedure prescribed under the guidelines of State of Chhattisgarh, Women and Child Development Department, impugned order dated 07.10.2022 has been issued and the services of the petitioner as Angan Badi Sahika has been terminated. Learned counsel would draw attention of this Court towards the covering memo filed by her and would refer to the circular dated 02.04.2008 issued by State of Chhattisgarh, Women and Child Development Department, specifically at paragraph 13 of the said circular which is related to termination of Angan Badi Karyakarta/Sahaika. She would submit that the order of termination of services of the petitioner is not in accordance with law and as such, the same may be quashed/set aside and this Writ Petition may be allowed.
