Order Sheet they executed sale deed in respect of certain land in favour of third party without consent of complainant who claims to be joint ownership over the said property. It is alleged that while executing sale deed, the age of complainant shown as 17 years and on that basis the transaction was sought to be termed illegal.
Learned counsel for the petitioners would submit that the subject land was purchased on 21.05.1995 from one Kamla Bai wherein the petitioners as well as complainant were shown as purchasers. The complainant was being represented by petitioner No.1 as his lawful guardian. The entire sale transaction was paid by the petitioner No.1. Thereafter, the said property was sold to third party vide registered sale deed on 12.05.1999.
The contention of the petitioner is that despite having knowledge of sale, the complainant did not raise any objection for more than two decades and it was only in the year 2021 he filed a civil suit with respect to subject land seeking declaration of title and partition and having failed to obtain relief in civil proceeding, the complainant, as an afterthought, lodged the FIR on 01.03.2025 with inordinate delay of about 23 to 27 years in which charge sheet has been filed without conducting fair investigation.
