1 The petitioner has preferred this writ petition under Article 226 of the Constitution of India seeking following reliefs :-
10.1) This Hon'ble Court may kindly be pleased to call for the entire records pertaining to the case from the respondents.
10.2) That, the Hon'ble Court may kindly be pleased to issue appropriate writ by directing the respondent authorities for re-checking/revaluation of the Supplementary Exam of MBBS 1st Year Anatomy Subject Paper 1 & 2 of the Petitioner.
10.3) Any other relief which this Court may think proper in view of facts and circumstance of the case may also kindly be granted.
2 Learned counsel for the petitioner would submit that, the petitioner is a medical student of M.B.B.S. course in the college of respondent No. 4 i.e. Raipur Institute of Medical Sciences, Raipur of the batch 2024-25. She participated in the examination of first year M.B.B.S. in the month of August – September, 2025. She failed in two subjects i.e. Anatomy and Physiology in both the theory and practical examination, therefore, she participated in supplementary examination, in which she passed in one subject – Physiology, but again failed in Anatomy subject. Her application for re-totaling of marks was allowed, but in re-totaling also, there was no change in her marks. Therefore, she has filed instant writ petition seeking relief of re-checking/ re-valuation of copy of paper of subject Anatomy I and II of supplementary examination. Hence, he prays that this writ petition may be admitted for hearing.
3 In reply, learned counsel for respondents No. 2 and 3 submits that, there is no provision for rechecking/ revaluation of copy of paper of any subject in supplementary examination, in the ordinance, statute or rules of the University. Therefore, this writ petition deserves to be dismissed out-rightly.
4 Learned Panel Lawyer appearing for the State extended his support to the contention made by learned counsel for the respondents No. 2 and
3.
5 When specific question was posed to learned counsel for the petitioner whether there is any ordinance, statute or rules for re-checking / revaluation of paper of any subject of supplementary examination of M.B.B.S., he submits that, there is no such ordinance, statutue or rules etc.
6 Having considered aforesaid contention of learned counsel for both the parties, since there is no provision for rechecking/ revaluation of copy of paper of any subject in supplementary examination, in the ordinance, statute or rules of the University, therefore, this Court is not inclined to entertain this writ petition.
7 In view of above, this writ petition is dismissed at motion stage. 8 Pending interlocutory application(s), if any, stands disposed of.
