C A V Judgment
1. The present appeal has been filed by the plaintiffs under Order 41
Rule 1 of the Code of Civil Procedure, 1908, assailing the judgment dated 20.03.2024 passed by the learned 6th Additional District Judge, Bilaspur (C.G.) in Civil Appeal No. 29-A/2022 (Ajay Sidara vs. Ajay Kumar & Ors.), reversing the judgment and decree dated 19.08.2016 passed by the learned 4th Civil Judge, Class-I, Bilaspur (C.G.), in Civil Suit No.37-A/2011 (Ajay Kumar & Others v Khagendra Manhar & Others), whereby the civil appeal filed by one Ajay Sidara (who was not impleaded as a party in the civil suit) was allowed and the judgment and decree of the trial Court is set aside by the learned First Appellate Court and the case is remanded back to the trial Court for fresh adjudication with a direction to restore the civil suit to its original number, affording the parties opportunity of hearing and to adduce evidence. For the sake of convenience, the parties shall hereinafter be referred to
as per their status before the Trial Court.
2. In the present case, a third party, namely Ajay Sidara, who was
not impleaded as a party in the original civil suit, preferred an appeal under Section 96 of the CPC before the learned First Appellate Court. It was contended by him that the suit property had initially been sold by defendan
