1. With the consent of learned counsel appearing for the parties, this

case is heard finally.

2. Petitioner has filed this writ petition seeking following reliefs:-

“10.1 Issue a writ of certiorari or any other appropriate writ, order, or direction to quash the

impugned attachment order dated 17.01.2025.

10.2 Issue a writ of mandamus directing Respondent no 3 to send back the petitioner to his original place of posting that is tehsil office

Raigarh.

10.3 Grant any other relief(s) as this Hon'ble Court may deem just and proper in the facts and

circumstances of the present case;

10.4 And for this act of kindness, the petitioner as in duty bound shall ever pray.”

3. Learned counsel for the petitioner submits that the petitioner while working on the post of Assistant Grade-II was put under suspension vide order dated 07.07.2024. Thereafter, vide order dated 17.01.2025, suspension of petitioner has been revoked and he was attached to Tahsil Office- Kharsiya, District- Raigarh. On the date of suspension, petitioner was posted in Tahsil Office, Raigarh and as of now, it is ordered that salary of petitioner is to be drawn from Tahsil Office Raigarh, which shows that petitioner has been attached to Tahsil Office, Kharsiya. Referring to Clause 1.5 of Circular dated 5^th June 2025 issued by the State Govt. he submits that under Clause 1.5 it is

clearly mentioned that all the district level employees who have been working under attachment their attachment will be cancelled automatically and if required those employees are to be posted on transfer . Petitioner has not been posted in accordance with law but the wordings used in order Annexure P-1 clearly depict that it is an attachment of petitioner in another office. Petitioner had submitted representation before respondents No. 2 & 3 which is pending

consideration .

4. Learned counsel for the State submits that as the representation submitted by petitioner is still pending consideration, it may be

considered and decided in accordance with law.

5. I have heard learned counsel for the parties and also perused the

documents annexed along with this writ petition.

6. Perusal of order Annexure P-1 by which petitioner is posted after revocation of suspension would show that petitioner though posted in Tahsil Office Kharsiya, however, salary of petitioner is to be drawn from Tahsil Office Raigarh from which it can be discerned that though petitioner is directed to work at Kharsiya, but posting of petitioner is not

in Tahsil Office, Kharsiya.

7. Considering the aforementioned facts of case in particular Clause 3 of the order Anenxure P-1 wherein petitioner has been directed to work in one office and salary is to be drawn from other office, Circular issued by State Govt. dated 5^th June 2025 in particular Clause 1.5 thereof, representation submitted by petitioner is pending consideration, this writ petition is disposed of directing respondents No. 2 & 3 to consider and take decision on representation submi
