2026 Supreme(Online)(Chh) 10171

IN THE HIGH COURT OF CHHATTISGARH AT BILASPUR
Ramesh Sinha, CJ, Ravindra Kumar Agrawal, J
Tukeshwar Lal Sahu – Appellant
Versus
State Of Chhattisgarh – Respondent
WA No. 257 of 2026

Advocates:
For the Appellants/Petitioners: Shiv Sewak Manjhi
For the Respondents: Prasun Kumar Bhaduri

Employees appointed under the Panchayat department are governed by distinct statutory rules and service conditions, and therefore cannot claim the benefit of time-bound pay scales or circulars specifically intended for regular State Government employees, nor can they claim arrears for a period prior to their formal absorption into the government service.

Headnote:(A) Chhattisgarh Panchayat Raj Adhiniyam, 1993 - Section 95 - Chhattisgarh Panchayat Shiksha Karmi (Recruitment and Conditions of Service) Rules, 2007 - Kramonnati Vetanman - Benefit of time-bound pay scale - Appellants, former Shiksha Karmis, claimed parity with State Government employees regarding the circular dated 10.03.2017 - Court held circular applies only to regular Government servants - Panchayat employees governed by distinct rules - No right to claim arrears prior to absorption into school education department on 01.07.2018. (Paras 21, 23, 26)

Facts of the case:
The appellants, previously appointed as Shiksha Karmis under various Panchayats between 2008 and 2013, were absorbed into the School Education Department in 2018. They sought the benefit of Kramonnati Vetanman (time-bound pay scale) as per a 2017 government circular, claiming parity with other employees. The Single Judge dismissed their petitions, leading to the current appeal.

Findings of Court:
The Court observed that appellants were Panchayat employees before their 2018 absorption and were governed by separate statutory rules, not the circulars applicable to State Government employees. Furthermore, the absorption order explicitly barred claims for arrears prior to 01.07.2018.

Issues: Whether Panchayat-cadre employees are entitled to the benefit of Kramonnati Vetanman under the Circular dated 10.03.2017 applicable to State Government teachers.

Ratio Decidendi: Prior to absorption, Panchayat employees formed a distinct cadre with different service conditions; they cannot claim retrospective pay-scale parity nor arrears governed by state-employee circulars, especially when absorption terms specifically exclude pre-2018 arrears.

Result: Appeals dismissed.
