Order on Board

1. By way of this Writ Petition, the petitioner has prayed for the following reliefs:-

10.1 The Hon'ble Court may kindly be pleased to call for the records from the authorities and thereafter the order dated 31.10.2025 passed by the STAT Raipur( Annexure P/1) be quashed as the same is illegal, arbitrary and against the settled principles of law so far as it relates to remanding back the matter to the RTA Raipur is concerned in the interest of justice.

10.2 That, the Hon'ble Court may further be pleased to stay the further proceedings of the RTA relates to rehearing of the matter as directed by the STAT as per order impugned till the next date of hearing.

10.03 Any other relief which this Hon'ble Court may deems fit and proper looking to the facts and circumstances of the case may also be awarded to the petitioner including the cost and expenses of this petition. An affidavit in support of this petition is filed herewith.

2. Learned counsel for the petitioner submits that the petitioner is a bus operator and plying his buses on the strength of permit granted by the state authorities from time to time. Respondent No.3 filed an application for grant of permanent stage carriage permit from Raipur to Jagdalpur via Abhanpur, Dhamtari, kanker, Kondagaon, Bastar and return was filed by the respondent no. 3 on 14.06.2018. It is further submitted that the application of the respondent no.3 has been published in agenda and matter was heard and as the matter was remitted by the State Transport Appellate Tribunal again the matter was published in the agenda and heard on 17.03.2023. The petitioner and other route operators raised an objection but the respondent no.2 has allowed the application of Respondent No.3 vide order dated 23.08.2023 (Annexure P/3) with certain conditions. Challenging the said order dated 23.08.2023, the petitioner preferred a revision being Revision No.57 of 2025 before the State Transport Appellate Tribunal, Chhattisgarh Raipur who in turn partly allowed the revision of the petitioner and remanded the matter back to the Respondent No.2 to decide the matter afresh in accordance with law within a period of 60 days from 31.10.2025, which has not been decided yet. Hence, appropriate direction may be issued to Respondent No.2 to decide the matter as expeditiously as possible.

3. Considering the submission made by counsel for the petitioner and the fact that Respondent No.2 was directed by STAT, Chhattisgarh to decide the matter afresh within a period of 60 days counting from 31.10.2025, which has not been decided till date, as such, Respondent No.2 is directed to decide the matter in light of the order dated 31.10.2025 passed by the STAT, in accordance with law within a period of 60 days from the date of receipt of copy of this order.

4. With the aforesaid direction, this Writ Petition is disposed of.
