Order on Board

1. This is the First bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 97/2025 registered at Police Station – Patna, District Koriya (C.G.), for the offence punishable under Section 22 (C) of the Narcotics Drugs and Psychotropic Substances Act.

2. As per the prosecution story in brief, on 26.04.2024, secret information was received by the police. On the basis of such information, the police reached the spot and intercepted the applicant and three other accused persons. Upon being questioned, they disclosed their identities. From the possession of Rajesh Kumar, Pyeevon Spas Plus capsules comprising 30 strips (each strip containing 8 capsules, totaling 240 capsules) along with a motorcycle were seized. From the present applicant, Pyeevon Spas Plus capsules comprising 30 strips in two boxes (totaling 280 capsules) along with a motorcycle were seized. From the possession of co-accused Sakil, 30 strips (each strip containing 8 capsules, totaling 240 capsules) were seized. Thereafter, the applicant and other co-accused persons were arrested for the commission of the alleged offences.

Learned counsel for the applicant submits that the present applicant has been falsely implicated in this case and the alleged contraband article was not seized from the possession of the present applicant. He also submits that the present applicant has no criminal antecedents and he is in jail since 26.04.2025, and conclusion of the trial may take some time, therefore, he prays for grant of regular bail to the present applicant.

On the other hand, learned State counsel opposes the bail application of the present applicant and submits that in the present matter the charge-sheet has been submitted before the competent Court. He further submits that the bail of other co-accused person, namely, Rajesh Kumar Gupta in MCRC No. 1882 of 2026 has already been rejected by this Court, vide order dated 24.02.2026, therefore, the bail application of the present applicant is also entitled to be rejected.

5. I have heard learned counsel appearing for the parties and perused the case diary.

Considering the facts and circumstances of the case and the fact that the bail of other co-accused person, namely, Rajesh Kumar Gupta in MCRC No. 1882 of 2026 has already been rejected by this Court, vide order dated 24.02.2026 on merits, therefore, the bail application of the present applicant is also entitled to be rejected.

Accordingly, the bail application of the applicant – Vijay Kumar Ravi filed under Section 483 of the BNSS, involved in Crime No. 97/2025 registered at Police Station – Patna, District Koriya (C.G.), for the offence punishable under Section 22 (C) of the Narcotics Drugs and Psychotropic Substances Act, is rejected.

8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously.

9. OfÏce is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith.
