Facts of the case:
Petitioners, who retired from service prior to 01.09.2014, sought revision of their pension based on their actual salary instead of the statutory wage ceiling. Relying on judicial pronouncements, they had previously applied for higher pension, which pension authorities initially granted but later cancelled, leading to the impugned reduction in monthly pension. The authorities argued that the petitioners lacked eligibility as they had not exercised a joint option during their service and had exited the membership of the pension fund upon superannuation before the amended 2014 scheme came into force.

Findings of Court:
The Court noted that the definition of a 'member' clarifies that an employee ceases to be a member upon attaining the age of superannuation. Since the petitioners retired before the 2014 amendment and failed to exercise the required joint option under the pre-amended scheme, they are not entitled to the benefit of the higher pension. The Court emphasized that the 2014 amendment and the associated beneficial interpretations are strictly applicable to those who were 'existing members' as of 01.09.2014.

Issues: Whether employees who retired prior to 01.09.2014 without exercising a joint option under the pre-amended pension scheme are entitled to avail the benefit of higher pension based on actual salary.

Ratio Decidendi: An employee who has retired prior to the 2014 amendment without exercising the mandatory joint option ceases to be a member of the pension fund upon retirement. Consequently, they do not qualify as 'existing members' under the amended scheme and cannot claim the benefit of higher pension based on actual salary components.
