1. The applicant has preferred this First Bail Application under Section

483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 49/2025, registered at Police Station – Bacheli, District – Dantewada (C.G.) for the offence punishable under Sections 316(5), 336(3), 3(5),

318, 338, 340 and 61 of the Bharatiya Nyaya Sanhita, 2023 (BNS).

2. The case of the prosecution, is that on 25.11.2025 a surprise

inspection was conducted at English composite liquor shop Bacheli. During the physical inspection of the shop 92,09,370/- (Ninety Two

Lakhs Nine Thousand Three Hundred seventy). Further amount of Rs. 60,38,404 (Sixty lakhs Thirty Eight Thousand Four Hundred four) has not been deposited in the Bank Account. Therefore, the amount of Rs. 1,52,47,774/- (One Crore Fifty Two lakhs Forty Seven Thousand Seven Hundred Seventy Four) has been embezzlement by fraud by the accused persons i.e. Applicant, Kosuri Chandrashekhar, Rakesh Uike, Devendra Kumar Paikara, Ajay Kumar Sharma. Further the co-accused Ajay Kumar Sharma has taken the money through UPI id from the shop and taken bottles of liquors from the shop have embezzlement the money from the shop. Further the audit of the shop has been done till September 2025. Therefore, the embezzlement of money has been done from 01.10.2025 till 24.11.2025. Therefore, the First Information Report, has been registered Under Section 316(5) R/w. Section 3(5) of the Bharatiya

Nyay Sanhita, has been registered against the present applicant.

3. It is argued by the learned counsel for the applicant that the

applicant is innocent and has been falsely implicated in this case and there is no criminal antecedents registered against the present applicant. It is further submitted that the charge-sheet has been filed in this case and co-accused has already been granted bail by this Court vide order dated 29.01.2026 in MCRC No.10419 of 2025. The applicant is in jail since 28.11.2025 and trial is likely to take quite long time for its conclusion, therefore, he prays for grant of bail on

the ground of parity.

4. On the other hand, the learned State counsel opposes the bail

application and submits that there is no criminal antecedents registered against the present applicant, and the charge-sheet has been filed in this case, but could not disputed the fact that co-

accused person has already been granted bail by this Court and the

case of the present applicant to that of the co-accused.

5. I have heard learned counsel for the parties and perused all of the

documents available on record.

6. Taking into consideration the facts and circumstances of the case,

nature and gravity of allegation levelled against the applicant and the fact that there is no any criminal antecedents registered against the present applicant, charge-sheet has been filed against the applicant, co-accused has already been granted bail by this Court vide order dated 29.01.2026 in MCRC No.10419 of 2025 and the applicant is in jail since 28.11.2025 and conclusion of the trial is likely to take some

time, I am inclined to allow this application.

registered at Police Station – Bacheli, District – Dantewada (C.G.) fo
