1. This Writ Petition has been filed against the orders dated 24.03.2022 (Annexure P/1) passed by Respondent No.3 and order dated 07.02.2022 (Annexure P/2) passed by Respondent No.5 by which, representations made by petitioner No.1 (wife of late Rameshwar Prasad Rate, Deceased employee) for grant of compassionate appointment to her younger son i.e. Petitioner No.2 has been rejected.

2. Reliefs as sought by the petitioners are that :-

10.1 That this Hon'ble Court be pleased to call for the records of the case from possession of the respondents for its kind perusal.

10.2 This Hon'ble Court be pleased to issue a writ in the nature of Mandamus directing concerned authorities to consider petitioner No.2 for compassionate appointment and to appoint him if found qualified for the same.

10.3. This Hon'ble Court be further pleased to pass such other orders in favour of the petitioner against the respondents as it may deem fit under the facts and circumstances of the case.

3. Necessary facts of the case are that on 24/03/2022 Petitioners through a letter from the Director General of Police, Police Headquarters, Nava Raipur, Chhattisgarh were informed that as Late Shri Rameshwar Prasad Ratre had already been retired on 18/08/2017 therefore at the time of his death on 12/08/2018 he was not an employee in regular service hence the application for compassionate appointment cannot be considered. That similarly on 07/02/2022 another letter was received by the petitioner from Senior Superintendent of Police Raipur wherein it is stated that as Late Shri Rameshwar Prasad Ratre was already retired on 18/08/2017 therefore at the time of his death on 12/08/2018 he was not an employee in regular service hence application for compassionate appointment cannot be considered. That husband of petitioner No.1 and father of petitioner No.2 Shri Rameshwar Prasad Ratre was initially appointed as Sub-Inspector on 01/06/1983 and was posted at various places and was performing his duties and obligations with commitment and utmost sincerity but unfortunately on 27/12/1997 upon a fabricated graft case he was arrested by the Special Police Establishment (Lokayukata) Bhopal Unit Raipur and was prosecuted under sections 7, 13 (1) (d) and 13 (2) of the Prevention of Corruption Act 1988 and was released on Bail on the same day. Thereafter he was suspended on 16/03/1998. On 09/04/2002 Shri Ratre was convicted in Special Criminal Case No. 07/1998 by the Special Judge (Prevention of Corruption Act)/ 1" Additional Sessions Judge, Raipur (Chhattisgarh) under section 7 and 13 (1) (d) read with section 13 (2) of Prevention of Corruption Act, 1982 and was sentenced to undergo Rigorous Imprisonment for one year with fine of Rs.1,000/- and Rigorous Imprisonment for one year with fine of Rs.1,00
