2. This writ petition has been preferred by the petitioner under Article 226 of the Constitution of India, seeking following reliefs:-

10.2 That, this Hon’ble Court may kindly be pleased to allow the petitioner to run the institute at the same place and further be pleased to direct the respondent authority and not take any steps for de-affiliation of the petitioner institute.

10.3 That, the Hon’ble Court may kindly be pleased to direct the respondent No.2 to take steps regarding the uploading the data of the student of the petitioner institute in the portal NCVTMIS for the session so that the session can be completed without any hurdle.

10.4 Any other relief, which this Hon’ble Court deems fit and proper, may also kindly be granted to the petitioner, in the interest of justice.”

Brief facts of the case are that petitioner is a private ITI institute run by its principal, which was earlier being run at Shikha Vatika, Madhuban Road, Dayalband, Bilaspur (C.G.) from September, 2014 to November, 2017. However, since the said place was not appropriate for running the institution, as such it was shifted to Village Khaira (Lagra – Gatoura Road). When the authorities came to know about the same, they have issued a notice to the petitioner and when reply was not found to be satisfactory, the name of the said institute was removed from affiliation portal. Hence, this petition has been filed.

Learned counsel for the petitioner submits that since the place where institute was running earlier was not appropriate, as such it has been re-located to the Village Khaira (Lagra – Gatoura Road), District Bilaspur (C.G.). It is further submitted that the impugned order is liable to be quashed and the authorities may be directed to grant affiliation to run the ITI institute.

Learned counsel for the State/respondents submits that after passing of the order dated 09.10.2019, the institute has been closed and it is not being run since last 6 years, hence no relief can be granted at this stage to run the institution. If, the petitioner seeks to get a new affiliation, then he may move an appropriate application before the concerned authorities for grant of permission of affiliation.

6. I have heard learned counsel for the parties and perused the material available on record.

7. From bare perusal of the record, it appears that the order impugned was passed way back on 09.10.2019, thereafter no any interim order has been passed in favour of the petitioner. After l
