1. This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.43/2026 registered at Police Station – Lakhanpur, District- Surguja (C.G.) for the offences punishable under Sections 69 of Bhartiya Nyay Sanhita for short BNS,2023.

Case of the prosecution, in brief, is that on 21.02.2026, the victim lodged written report at concerned Police Station alleging therein that on 15.06.2022, the applicant has committed sexual intercourse with her on the pretext of marriage and from 15.06.2022 to 07.02.2026 on several times, thereafter refuse to marry her. The social meeting was also covenced and the family members are not ready for marriage of applicant and victim. On the basis of said report aforesaid offence has been registered against the applicant.
3. Learned counsel for the applicant submits that the applicant is innocent and he has falsely been implicated in the present case. He further submits that victim is a major lady. He also stated that there was love relationship between the victim and applicant from 15.06.2022 to 07.02.2026 and she was consenting party. He also submits that applicant and victim belong to same patronymic (Goutra), therefore there is no possibility of marriage between them, hence family members of applicant are not ready for marriage of applicant and victim. Moreover, investigation and trial are likely to take time, therefore, he submits that the present applicant is entitled to be released on anticipatory bail.
4. On the other hand, learned State counsel would oppose the prayer for grant of anticipatory bail and she further submits that as per the 183 of BNS statement of the victim goes to show that she was in love relationship with the applicant from
15.06.2022 to 07.02.2026 and they had physical relation and now the applicant has refused to marry her.
5. I have heard learned counsel for the parties and perused the case diary.

Considering the facts & circumstances of the case, gravity of offence, allegation levelled against the present applicant, also considering the fact that victim is a major lady and she was consenting party, also considering the 183 of BNS statement of the victim, investigation and trial are likely to take time, therefore, I am inclined to grant anticipatory bail to the present applicant.
7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Dinesh Rajwade on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:-
(a) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court.
(b) The applicant shall not act in any manner which will be prejudicial to fair and expeditious trial.
(c) The applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial.
(d) The applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which
