2026 Supreme(Online)(Chh) 12699

IN THE HIGH COURT OF CHHATTISGARH AT BILASPUR
Ramesh Sinha, CJ, Ravindra Kumar Agrawal, J
Kamla Tiwari – Appellant
Versus
State Of Chhattisgarh – Respondent
WA No. 231 of 2026

Advocates:
For the Appellants/Petitioners: Shiv Sewak Manjhi
For the Respondents: Prasun Kumar Bhaduri

Employees under the Panchayat cadre, prior to their formal absorption into the State School Education Department, are governed by separate service rules and cannot claim benefits under government circulars specifically intended for regular State government employees.

Headnote:(A) Chhattisgarh Panchayat Shiksha Karmi (Recruitment and Conditions of Service) Rules, 2007 - Kramonnati Vetanman - Claim for benefit under Circular dated 10.03.2017 - Appellants were Shiksha Karmis under Panchayat Department - Services absorbed into School Education Department only in 2018 - Circular dated 10.03.2017 applies only to Government servants under School Education Department - Panchayat employees not entitled to parity with State Government employees - Absorption order dated 30.06.2018 explicitly bars arrears prior to 01.07.2018. (Paras 23, 27, 30)

Facts of the case:
Appellants, initially appointed as Shiksha Karmis by Janpad/Zila Panchayats between 1998 and 2008, sought parity with Government school teachers regarding the grant of Kramonnati Vetanman as per the State Circular dated 10.03.2017. Their writ petition was dismissed by the Single Judge, leading them to prefer this writ appeal seeking the same benefits.

Findings of Court:
The Court held that appellants were Panchayat employees before their 2018 absorption and were governed by statutory frameworks of the Panchayat department, not government service rules applicable to the school education cadre. The Circular of 2017 is inapplicable to Panchayat cadre employees. The court also noted that the absorption policy specifically excluded payment of arrears prior to 01.07.2018.

Issues: Whether Shiksha Karmis (Panchayat cadre) are entitled to the benefit of the government circular dated 10.03.2017 regarding Kramonnati Vetanman at par with State Government school teachers.

Ratio Decidendi: Employees governed by a distinct statutory framework (Panchayat Rules) cannot claim the status of Government servants for the purpose of pay-scale circulars issued exclusively for the State Government school service cadre. Result : Appeal dismissed.
