Order on Board

12/03/2026

1. Heard.

2. This petition has been preferred by petitioner under Article 226 of the Constitution of India seeking following reliefs:-

“10.1 That, the Hon’ble Court may kindly be pleased to issue direction to the respondents to correct the revenue records by making entry of the petitioner’s name within earliest 30 days. They may further be directed to inquire the matter who deleted the petitioner’s name from revenue records. Further prayed that the revenue case un-registered pending before the Additional Tahsildar, Bilaspur may be considered within 30 days.

10.2 That, the Hon’ble Court may further be pleased to pass any order, direction to issue any suitable writ as may deem fit under the circumstances of the case including the cost of the petition.”

3. Learned counsel for the petitioner submits that the petitioner purchased a plot bearing Sheet No.3, Plot No.115, Block No.4, Khasra No.28/1, admeasuring 1800 sq. ft., situated at Mohalla Talapara, Bilaspur, P.H. No.35 from Smt. Vimla Devi Khandelwal. Thereafter, in Revenue Case No.192/A-6/86-87, the Sub-Divisional Officer (Revenue), passed mutation order on 13.05.1987 in favour of the petitioner. Subsequently, the petitioner came to know that his name was not reflected in the revenue record. Therefore, the petitioner filed an application dated 28.07.2025 (Annexure -P/2) under Section 113 read with Section 115 of the Chhattisgarh Land Revenue Code, 1959 for correction of the record. However, without registering the aforesaid application as a revenue case, the Additional Tahsildar, Bilaspur has been granting dates repeatedly. Hence, learned counsel prays that, at this stage, the present writ petition may be disposed of with a direction to Respondent No.2, the SDO (Revenue), Bilaspur to register the revenue case and decide the aforesaid application within a stipulated period.

4. In reply, learned State counsel submits that the application dated

28.07.2025 (Annexure -P/2) filed by the petitioner does not bear the seal or signature of the office of the SDO (Revenue).

5. Having considered the limited grievance of the petitioner and further considering the fact that the revenue authorities are granting dates repeatedly without registering the aforesaid application, the present writ petition is disposed of at this stage directing Respondent No.2, the SDO (Revenue), Bilaspur, to register a revenue case in respect of the application dated 28.07.2025 (Annexure -P/2) filed by the petitioner. Thereafter, Respondent No.2 or the competent authority is directed to decide the said application/revenue case in accordance with law, expeditiously, preferably within a period of 60 days from the date of receipt/submission of a copy of this order.

6. With aforesaid observations and directions, the writ petition stands disposed of

7. Pending interlocutory application(s), if any, also stands disposed of. No order as to cost(s).
