1. This is First anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.14/2026 registered at Out Post Manora, Police Station - Jashpur District- Jashpur (C.G.) for the offences punishable under Sections 64(2)(m), 65(1), 69, 87 of BNS, 2023 and Sections 4,6 of POCSO Act.

Prosecution case in brief is 08.01.2026 the prosecutrix lodged a report alleging that, the applicant has made physical relationship with her on the pretext of marriage from 01.11.2025 to 07.12.2025, further alleged that, the present applicant came her village Tempu since 2015 from that time she and applicant have know each other and the applicant has made physical relationship continuously since 2015 to 2017 and thereafter they have stop to talk to each other from 2017. That, the further she alleged that, on 07.12.2024 the applicant has taken the victim in the house of his friend situated at Near Sharab Bahtti Road, Jashpur where they again make physical relationship due to which she become pregnant on 01.01.2025 then she told about her pregnancy to the applicant and he has given to her Jaggery to eat for abortion but she not taken the same and on 07.09.2025 she delivered a boy child. That, she further alleged that, the present applicant refused to get marriage with her and he refused to let her and her child stay with him, so on the basis of the said report the concerning police of Out Post Manora, P.S. Jashpur (C.G.) registered the Case in Crime No. 14/2026 for the offence U/s 64(2)(m), 65(1), 69, 87 of BNSS and section 4, 6 of POCSO Act and sought to arrest the applicant in the alleged commission of offence.
3. Learned counsel for the applicant submits that the applicant is innocent and he has falsely been implicated in the present case. He would submit that the incident took place on 07.12.2024 and the victim lodged report on 08.01.2026, so there is huge delay of about more than 1 year, but there in no explanation has been given by the prosecution. Further more investigation and trial are likely to take time, therefore, he submits that the present applicant is entitled to be released on anticipatory bail.

On the other hand, learned State counsel opposed the prayer for grant of anticipatory bail and submits that as per the statement recorded under Section 183 of BNS of the victim, wherein she deposed that there was love affair between the applicant. The applicant made physical relations with the victim several times, as a result of which she became pregnant and gave birth to a male child, but the applicant refused to marry her. Therefore, the present anticipatory bail application of the applicant is liable to be rejected.
5. I have heard learned counsel for the parties and perused the case diary.
