1. Learned counsel for petitioner submits that petitioner is holding the post of Assistant Grade - III and was posted at Government Higher Secondary School, Kargikala, Block – Kota, District - Bilaspur. State Government has taken a decision to establish English/Hindi Medium School in the name and style of Swami Atmanand Excellence English/Hindi Medium School by upgrading the existing school. School in which the petitioner is posted i.e. Higher Secondary School, Kargikala, Block – Kota, District - Bilaspur has been upgraded and converted as Swami Atmanand Excellence English Medium School. He also contended that according to the policy teachers in Swami Atmanand Excellence English/Hindi Medium School are to be appointed on contract or to be posted on deputation for which consent of the employee is required. Petitioner was asked to submit consent, however, he refused to give consent for his posting in Swami Atmanand Excellence English/Hindi Medium School and no other order has been passed and since then petitioner is still performing his duties in the Swami Atmanand Excellence English/Hindi Medium School without being any proper order in this regard.

He further submits that in the above facts of the case, he may be permitted to submit representation before the Respondents No. 3 & 4 and direction be issued to the Respondents No. 3 & 4 to consider and take decision on the representation to be submitted by the petitioner at the earliest within specified time frame.

3. Learned State counsel submits that in view of the limited prayer made by leaned counsel for petitioner, he is having no objection.

4. On due consideration on the submission of learned counsel for parties and nature of grievance raised, this writ petition at this stage is disposed of permitting petitioner to submit fresh comprehensive representation before Respondents No. 3 and 4 and if such representation is submitted, Respondents No. 3 and 4 shall consider and take decision on the representation to be submitted by petitioner expeditiously preferably within further period of 03 months from the date of receipt of representation.

5. With the aforesaid observations and directions, this writ petition stands disposed of.
