1. This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 92/2025 registered at Police Station – Cyber Range Khamhardih, District - Raipur (C.G.) for the offence punishable under Sections

318(4), 3(5) of Bhartiya Nyay Sanhita for short BNS, 2023.

2. Case of the prosecution, in brief, is that the Complainant has registered a complaint with Cyber Police Station Range Raipur which is registered as FIR no. 92/ 2025. It is alleged in the FIR that from the period 10.03.2025 to 06.04.2025 the complaint had deposited around Rs 40,00,000/- (Forty lacs rupees) in the bank account of ASK Investment Managers Limited, which was operated by 1. Priya Sharma and 2. Bharat Shah. During the course of investigation, it was discovered that some Rs 20,00,000/- (Twenty Lac Rupees) were siphoned in the account of the present accused/applicant. The said amount was transferred from the bank account no. 20100044073384 of Bank of Bank through RTGS on 08.04.2025. on this basis applicant has been made accused in this case.

It is argued by learned counsel for the applicant that the applicant is innocent and has been falsely implicated in crime in question and there is no previous criminal antecedent against the present applicant. He further submits that there is no connection of the present applicant with the bank accounts and mobile numbers used in the fraud. Further charge-sheet has already been filed in the present case, the applicant is in jail since 21.11.2025 and the conclusion of trial is likely to take some time, therefore, he prays for releasing the applicant on regular bail.

On the other hand, learned State counsel opposes the bail application and submits that there is no criminal antecedent registered against the present applicant, and the charge-sheet has been filed in this case. He would submit that in compliance of the Court’s order dated 10/02/2026, the concerned Investigating Officer has filed his personal affidavit.

5. I have heard learned counsel for the parties and perused the case diary.

6. In compliance of the Court’s order dated 10/02/2026, the Investigating Officer has filed his personal affidavit which reads as under:-

“ xxx xxx xxx “4. That, during the course of investigation, it was found that, on 08.04.2025, Rs.20 Lacs has been transferred through RTGS into the Bank Account Number 20100044073384 of the accused Bandhan Bank and the mobile number registered in it is 8222928217 and the said bank account number was found to be in the name of the firm M/s. Raut Enterprises, which was being operated by the accused Deepak Raut and the present accused. In this regard, a notice under Section 35 (3) was issued to the present accused persons to appear and submit satisfactory reply.

5. That, during investigation, the accused, the aforesaid bank account holder was summoned and questioned and his memorandum statements was taken infront of the relevant witnesses wherein he has categorically deposed that, his brother Deepak Kumar Raut, Resident of Village Janidapal, PS Tomka, District Jajpur, Odisha, on being lured that, a bank account is required for online gaming, if you provide it then you will give 1%
