After following due procedure of law as prescribed in the guidelines issued by the State Govt. for appointment of Panchayat Secretaries, petitioners were appointed as Panchayat Secretaries. It is contention of learned counsel for the petitioners that petitioners were appointed vide order dated 22nd March 2017. It is further contended that petitioners were terminated vide order dated 30th August 2017 observing that in the proceeding pending before the Commissioner Bastar Division, Jagdalpur of other 8 terminated Panchayat Secretaries, Commissioner has allowed the proceedings filed before him and directed for reinstatement of those Secretaries which are subject matter of the Case No .(1) 03/B-121/16-17, (2) 04/B-121/16-17, s (3) 05/B-121/16-17, (4) 06/B-121/16-17, (5) 07/B-121/16-17, (6) 08/B- 121/16-17, (7) 09/B-121/16-17 and (8) 10/B-121/16-17. It is contention of learned counsel for the petitioners that petitioners were granted employment after following due procedure of law and, therefore, against the order of termination, petitioners have submitted appeal before the Commissioner Bastar Division Jagdalpur. Appeal was allowed and order of termination of petitioners dated 30th August 2017 was set aside. He contended that as the petitioners have already joined their place of posting pursuant to the order of appointment, and therefore consequence of the order of Commissioner of setting aside order of termination is of reinstatement of petitioners herein. When respondents have not complied with the order of Commissioner, this writ petition is filed.
