A writ petition for recovery of gratuity may be disposed of when the respondent authority admits the entitlement to a specific amount and undertakes to make payment upon submission of required documentation.

Order On Board

1. Following relief has been claimed in this writ petition:-

“1. That the Hon’ble Court may be kind enough to call the record of the petitioner as well as other respondents.

2. That the Hon’ble Court may be kind enough to issue a writ/writs, order/orders, direction/directions and to command the respondents by writ of mandamus and to order the respondents to quash the impugned order and to order the respondent to pay the gratuity of Rs. 2,74,700/- with interest along with the payment of pension.

3. That the Hon’ble Court may be kind enough to issue any other writ, order or direction to the respondents in the interest of justice.”

2. Learned counsel for the petitioner submits that this writ petition was filed by the petitioner seeking the gratuity amount of Rs. 2,74,700/- with interest alongwith payment of pension. He submits that the grievance of the petitioner has been redressed by the respondent authority. He submits that order dated 23.02.2026, has been passed by the respondent authority wherein the petitioner was held to be entitled for Rs. 1,55,941/- as gratuity. Thereafter, vide communication dated 20.02.2026, certain documents including bank passbook, Pan card etc. were demanded from the petitioner to make the online payment of the said amount. Thus, he submits that this writ petition may be disposed of in light of the documents appended with the return.

Learned counsel for the respondent submits that the respondents have calculated the admissible gratuity for the amount of Rs. 1,55,941/- and that since the payment of the said amount is to be made online, the documents necessary for that is demanded from the petitioner vide communication dated 20.02.2026 (Annexure R/2).

4. In view of the submissions made by learned counsel for the parties, this writ petition is disposed of and it is expected that the respondent No. 3 shall make payment of the said amount within a period of 30 days after the submission of necessary documents which were demanded from the petitioner vide communication dated 20.02.2026.

5. All pending application(s) if any, stand disposed of. No cost.
