1. This contempt petition is filed alleging willful disobedience of
order dated 27.06.2025 passed in WPC No.2865 of 2025 by the
respondents.
2. Learned counsel for petitioner would submit that the petitioner
is a Rice Miller. Under Custom Milling Policy of State Govt. for kharif
marketing year 2023-24, petitioner has lifted paddy for custom milling.
After custom milling, as per the policy, rice was to be returned and
deposited with CMR (Custom Milling Rice) Centre. Petitioner has
deposited 34699.504 quintal of custom milled rice and thereafter portal
of petitioner was blocked making it unable to petitioner to deposit the
remaining/balance custom milled rice of 1766.869 quintals, against
which, petitioner has filed writ petition which was disposed off vide
order subject matter of contempt petition, directing respondents to
allow the petitioner to deposit balance custom milled rice on
30.06.2025. Petitioner pursuant to order passed by this Court has
transported custom milled rice through truck at CMR Centre, however,
possession of un-loaded custom milled rice at CMR Center Dabara ,
District- Sakti was not taken by respondents and thereby have
committed willful disobedience of order.
3. Learned counsel for the respondents would submit that during
course of argument at the time of hearing of writ petition specific
submission has been made by respondents that vide correspondence
issued by the State of Chhattisgarh to Co-operative Marketing
Federation Ltd. (for short “Markfed”) regarding shortage of CMR for
KMS 2023-24 i.e. Kharif Marketing Season 2023-24 there is express
direction from the State Govt. that rice to be deposited in the State pool

shall be exclusive of the shortage identified during the Joint Physical
Verification (JPV). Upon joint physical verification of the paddy lifted by
petitioner, done in the month of October 2024, officials of Markfed have
found shortage of 6655 bags of paddy which amounts to 1766.869 of
custom milled rice. It is contention of learned counsel for respondents
that till 30.06.2025, petitioner has already deposited custom milled rice
exclusive of shortage as found during Joint Physical Verification of
premises of petitioner in month of October 2024. It is also pointed out
that writ Court while passing the order has observed that balance
custom milled rice be permitted to be deposited by petitioner on
30.06.2025, was subject to correspondence dated 26.03.2025. Said
correspondence clearly mentions that custom milled rice found
shortage at the time of physical verification are not to be accepted.
4. At this stage learned counsel for the petitioner submits that
letter dated 10.02.2025 states that physical verification has to be re-
drawn.
