1) By way of this petition, the petitioner has sought following reliefs:-

“10.1 That, this Hon'ble Court may kindly be pleased to call the records from the respondents.

10.2 That, this Hon'ble Court may kindly be pleased to issue an appropriate writ, thereby setting-aside the impugned list declaring the petitioner ineligible (Annexure P/1) and further be pleased to set-aside the impugned select list (Annexure P/2).

10.3 That, this Hon'ble Court may kindly be pleased to direct the respondent authorities to select the petitioner for Patwari Training according to her merits.

10.4 That, any other relief/order which may deem fit and just in the facts and circumstances of the case including award of the costs of the petition may be given.”

2) Mr. Chandra Kumar, learned counsel appearing for the petitioner would submit that pursuant to an advertisement dated 26.10.2016, the petitioner participated in Patwari Recruitment Examination in the year 2017. He would contend that required eligibility criteria for the post of Patwari was : the Higher Secondary examination, knowledge of Computer(specifically Data Entry speed of 5000 key depressions per hour), or one year Diploma in Computer Operator and Programming Assistant or two years Diploma from a recognized Board of Technical Education in Computer Science/Information Technology/Modern Office Management or P.G. Diploma or Graduation or Post-Graduation in Computer Science/Information Technology/Computer applications. Mr. Chandra Kumar would submit that according to the advertisement, a candidate with one year Diploma in Computer Application was eligible for selection but the respondents rejected the candidature of the petitioner on the ground that the petitioner did not fulfill required eligibility criteria, thus, a direction may be issued to the respondent authorities to consider the case of the petitioner.

3) On the other hand, learned State counsel would oppose the submissions. He would submit that the petitioner possessed one year Diploma in Computer Application and thus, she was lacking required eligibility criteria, therefore, her candidature was rejected. He would further submit that the petition filed by the petitioner is misconceived and deserves to be dismissed.

4) I have heard the learned counsel appearing for the parties and perused the documents placed on record.

5) The required eligibility criteria prescribed for the post of Patwari in the advertisement reads as under :

"5. पटवारी पद हेतुशैक्षणिक अर्हता :-

(1) किसी मान्यता प्राप्त मंडल से(10+2) प्रणाली मेंहायर सेकेण्डरी परीक्षा उत्तीर्णहोना चाहिये।

(2) शासकीय/अर्द्धशासकीय या किसी मान्यता प्राप्त संस्था से कम्प्यूटर अ र्हता होना चाहिये。

(3) किसी मान्यता प्राप्त संस्था से प्रोग्रामिंग मेंन्यूनतम 01 वर्षीय डिप्लोमा / प्रमाण पत्र तथा डाटा एंट्री की 5000 की (key) डिप्रेशन प्रतिघंटे की गति ।

कम्प्यूटर अर्हता हेतुनिम्नांकित को ही सामान्य प्रशासन विभाग के परिपत्र क्रमांक एफ-9-4/2015/1/3 दिनांक 23.01.2015 के अनुसार मान्यता है:-

(1) मान्यता प्राप्त आई.टी.आई से कम्प्यूटर आपरेटर एण्ड प्रोग्राम असिस्टेन्ट व्यव साय मेंएक वर्षीय डिप्लोमा/सर्टिफिकेट ।

(2) मान्यता प्राप्त बोर्डऑफ टेक्नीकल एजुकेशन / राज्य तकनीकी विश्वविद्यालय द्वारा प्रदान किया गया कम्प्यूटर साईन्स / इन्फार्मेशन टैक्नोलॉजी / माडर्न आफिस मैनेजमेंट का डिप्लोमा (2 वर्ष सेअन्यून)

(3) वैधानिक रूप सेगठित किसी मान्यता प्राप्त विश्वविद्यालय / डीम्ड यूनिवर्सिटी/इंदिरा गांधी मुक्त विश्वविद्यालय / भोज विश्वविद्यालय द्वारा प्रदत्त कम्प्यूटर साईन्स / इन्फार्मेशन टैक्नोलॉजी / कम्प्यूटर एप्लीकेशन मेंपी.जी. डिप्लोमा अथवा स्नातक अथवा स्नात्कोत्तर उपाधि।

(4) DOEACC Society New Delhi द्वारा प्रदत्त विभिन्न डिप्लोमा।"

परन्तु अधिसूचित क्षेत्र के सफल स्थानीय निवासी अभ्यर्थी जो पटवारी पद पर प्रशिक्षण हेतुचयनित होंगे, उन्हें उक्त कम्प्यूटर संबंधी प्रमाण प्रस्तुत करनेहेतु01 वर्षकी छूट की पात्रता होगी।"
