a rustic villager, who is the sole surviving member of her family and is responsible for taking care of her children as well as her in-laws. It is further submitted that she is the only person in the family who could pursue the present matter; however, due to the aforesaid circumstances, she could not contact her counsel in time and was unable to properly instruct him for taking necessary steps for filing the cross appeal. Thus, the delay has been caused.

Learned counsel for the appellant, on the other hand, opposes the application and submits that the reasons stated therein are not sufficient to condone the delay in filing the cross appeal.

I have heard learned counsel for the parties and perused the documents available on record.

Considering the submissions made and the reasons assigned in the application, this Court is of the view that sufficient cause has been shown to condone the delay.

Accordingly, I.A. No. 03/2024 is allowed. T
