1. The present writ petition has been filed being aggrieved by the order dated 23.04.2026 passed by the Collector (Land Records Branch), District Raigarh (C.G.), whereby the petitioner, who was posted as Revenue Inspector, Revenue Circle Pusour, has been transferred to Revenue Circle Keshla.

Learned counsel for the petitioner submits that the petitioner was posted as Revenue Inspector at Revenue Circle Pusour and has remained posted there only for a period of about 11 months and thereafter transferred to Revenue Circle Keshla. vide the impugned order dated 23.04.2026 by the Collector of District- Raigarh. She would further submit that being aggrieved by the said transfer order, the petitioner has already submitted a representation/objection before the Collector, Raigarh on 30.04.2026 (Annexure P/2), however, the same is still pending consideration. It is further submitted that the impugned transfer order appears to be contrary to the Transfer Policy, 2025 issued by the State Government, wherein minimum tenure of one year has been contemplated. Hence, she prays that the respondents may be directed to consider and decide the pending representation of the petitioner within a stipulated period.

Per contra, learned State counsel opposes the prayer made by the petitioner and submits that the Collector is the competent authority to transfer Revenue Inspectors within the district in administrative exigency and for better administration. He would further submit that transfer is an incidence of service and no interference is warranted by this Court in exercise of jurisdiction under Article 226 of the Constitution of India.

Considering the submissions advanced by learned counsel for the parties and on perusal of the record, particularly considering the fact that the representation/objection submitted by the petitioner against the impugned transfer order is still pending before the Collector, Raigarh, this Court deems it appropriate to dispose of the present writ petition with a direction to the Collector, Raigarh to consider and decide the petitioner’s pending representation dated 30.04.2026 (Annexure P/2) strictly in accordance with law and applicable Transfer Policy, as expeditiously as possible, preferably within a period of four weeks from the date of receipt of certified copy of this order.
5. It is made clear that this Court has not expressed any opinion on the merits of the case and the competent authority shall consider and decide the representation independently in accordance with law.
6. With the aforesaid observations and directions, the present writ petition stands disposed of.
