1. The present writ petition has been filed by the petitioner against

the inaction on the part of the respondents in not considering the

petitioner as a trained teacher.

2. Learned counsel for the petitioner submits that the petitioner

seeks the benefit flowing from the circular issued by the State

Government dated 22.11.1979, which specifically envisages

waiver of the training requirement for declaring a teacher as a

trained teacher in the event the teacher has either completed 20

years of service or has crossed the age of 50 years.

3. According to learned counsel for the petitioner, the petitioner has

already crossed the age of 50 years and has also completed more

than 20 years of service. Therefore, in view of the aforesaid

circular, the petitioner is entitled to be declared as a trained

teacher.

4. At this juncture, learned counsel for the petitioner confines the

prayer to permitting the petitioner to submit a fresh representation

before the higher authorities along with all relevant documents,

which may be considered by the authorities concerned in

accordance with the applicable rules, regulations and circulars

governing the field, and if the petitioner is found entitled, the

benefit be extended expeditiously.

5. The limited prayer sought by the petitioner is not opposed by

learned State counsel, except submitting that the contentions

raised by the petitioner are required to be verified from the service

records of the petitioner.

6. In view of the submissions made by learned counsel for the

parties, the writ petition stands disposed of with a direction to

respondent Nos. 1 and 2 to take an appropriate decision

regarding the claim of the petitioner as to whether the petitioner is

entitled to exemption for being declared as a trained teacher or

not.

7. Let an appropriate decision in this regard be taken within a

reasonable time from the date of receipt of a copy of this order.

8. Accordingly, the writ petition stands disposed of.
