1. This first anticipatory bail application under Section 438 of the

Code of Criminal Procedure has been filed by the applicant, who

is apprehending his arrest in connection with Crime

No.154/2025 registered at Police Station Kumhari, District – Durg

(C.G.) for the offences punishable under Sections 318(4), 336(3),

340(2), 111(2), 338, 61(2) and 3(5) of BNS, 2023 major

“correspondence section in IPC is 420 and 34”.

2. Case of the prosecution case in brief is that the complainant

Radheshyam Verma, Tahsildar, Tahsil OfÏce Ahiwara, lodged a

written report alleging that certain persons fraudulently

misused User I.D. Code No. PAT430600016 allotted to Patwari

Krishna Kumar Sinha and prepared forged online revenue

records and land documents relating to lands situated at Village

Borsi, Chetua, Achhoti and Murmunda. During verification,

forged entries were found in Kisan Kitab and Khasra records in

the name of Pravin Kumar S/o Jaiprakash by using fabricated

documents and false signatures of the Patwari. Upon verification

from the Bhuiyan Portal and manual revenue records, the

documents were found forged and the forged entries were

subsequently deleted on the orders of the Sub-Divisional OfÏcer

(Revenue). It is alleged that the accused persons, in furtherance

of a criminal conspiracy, committed forgery and cheating by

preparing and using forged revenue documents, on the basis of

which Crime No.154/2025 was registered at Police Station

Kumhari, District Durg (C.G.) for offences punishable under

Sections 318(4), 336(3), 338, 340(2), 111(2), 61(2) of the BNS, 2023

corresponding to Sections 420 and 34 of the IPC.

3. Learned counsel for the applicant submits that the applicant is

innocent and has been falsely implicated in the present case

solely on the basis of the memorandum statement of co-accused

Ganesh Tamboli and that he has neither prepared any forged

document nor received any amount in connection with the

alleged offence. It is further submitted that the alleged loan was

sanctioned by the concerned bank ofÏcials only after due

verification of the revenue records and no direct allegation of

cheating is made against the applicant. Counsel also submits

that the applicant is not absconding and is availing his legal

remedy before the Hon’ble Apex Court in Special Leave Petiton

(Crl.) Diary No.18547/2026, wherein it is directed that no coercive

steps shall be taken against the applicant. It is further submitted

that similarly situated co-accused persons, namely, Amit Kumar

Maurya, Komal Chand Sahu, Ashok Kumar Uraon, Ganesh

Prasad Tamboli have already been granted bail by this Court vide

orders dated (24.02.2026, 03.03.2026, 03.03.2026,10.03.2026

passed in MCRC Nos. (1900/2026, 2097/2026, 2102/2026,

2241/2026) therefore, the present applicant is also entitled to

the benefit of parity.

4. Learned State counsel opposed the anticipatory bail application

submits that the allegations pertain to a well-planned conspiracy

involving forged Khasra and land records for obtaining illegal

financial benefits. However, could not dispute the fact that co-

accused, namely, Amit Kumar Maurya, Komal Chand Sahu,

Ashok Kumar Uraon, Ganesh Prasad Tamboli have already been

granted bail by this Court and in Special Leave Petition (Crl.)

Diary No.18547/2026 preferred by the applicant before the

Hon’ble Supreme Court, it was directed that no coercive steps

shall be taken against the applicant.
