HIGH COURT OF CHHATTISGARH AT BILASPUR
Ravindra Kumar Agrawal, J
MANISH AASRANI – Appellant
Versus
STATE OF CHHATTISGARH – Respondent
MCRC No. 4091 of 2026
For the Appellants/Petitioners: Goutam Khetrapal
For the Respondents: Vinod Tekam, Ashutosh Trivedi
Online gambling is categorized as an organized syndicate crime that adversely impacts the national economy; therefore, prima facie evidence of providing gambling IDs and financial transactions, coupled with criminal antecedents, justifies the rejection of bail.
Headnote:The applicant was charged under Sections 7 and 8 of the Chhattisgarh Gambling Prohibition Act, 2022, following allegations of providing IDs for online gambling platforms and engaging in betting activities. The prosecution relied on the memorandum statement of a co-accused, a seized mobile phone containing betting applications, and evidence of money transactions via PhonePe. The court found sufficient prima facie material to link the applicant to the offence. The central issue was whether the applicant was entitled to regular bail despite the evidence of his involvement and his criminal history. The court reasoned that online gambling is an "organized crime having various facets and adversely affecting the economy of the country" and constitutes a "syndicate offence committed by the accused persons through online mode," necessitating a strict approach to bail when sufficient material is present. Accordingly, the second bail application filed by the applicant, namely Manish Aasrani, is hereby rejected.
