By the present writ petition, the petitioners seek a direction to the respondent-Corporation to consider their cases for promotion to the next higher post in accordance with the applicable Service Rules. Learned counsel for the petitioners submits that the petitioners are presently working as Senior Sanitary Inspectors and the next promotional post is that of Chief Sanitary Inspector. It is further submitted that the post of Chief Sanitary Inspector is to be filled exclusively by promotion and, despite the availability of vacant posts, the respondent-Corporation has not considered the cases of the petitioners for promotion.
Learned counsel for the respondent-Corporation, on advance copy, submits that if the petitioners submit a fresh representation claiming promotion to the post of Chief Sanitary Inspector, the same shall be considered and decided in accordance with law, subject to availability of vacant promotional posts, within a period of 40 days from the date of receipt of such representation.
In view of the submission made by learned counsel for the respondent-Corporation, the writ petition is disposed of with a direction that, in the event the petitioners submit a fresh representation before the competent authority, the competent authority shall consider and decide the same, in accordance with law, by passing a reasoned and speaking order within 40 days from the date of receipt of such representation.
With the aforesaid direction, the writ petition is disposed of.
