HIGH COURT OF CHHATTISGARH AT BILASPUR
Ramesh Sinha, CJ
PAWAN KUMAR PASWAN – Appellant
Versus
THE STATE OF CHHATTISGARH – Respondent
MCRC No. 3752 of 2026

Advocates:
For the Appellants/Petitioners: Rahul Mishra
For the Respondents: Soumya Rai

Grant of regular bail is permissible when the charge-sheet has been filed and the trial is expected to take a long time, balancing the gravity of the offence with the period of detention.

Headnote:The applicant sought regular bail under S.483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in connection with an offence involving dacoity and assault under S.309(6), S.351(1), and S.310(2) of the Bharatiya Nyaya Sanhita, 2023. The prosecution alleged that the applicant and co-accused committed dacoity of Rs. 13,00,000/- by threatening and assaulting the complainant. The court noted that the charge-sheet had already been filed and the applicant had been in custody since 22.12.2025. The primary issue was whether the applicant was entitled to bail considering the gravity of the allegations versus the period of detention and the stage of the proceedings. The court reasoned that since the charge-sheet has been filed and the trial is likely to take a considerable amount of time, the detention period justifies the grant of bail. Let applicant, Pawan Kumar Paswan, involved in Crime No.322/2025, registered at Police Station – Jashpur, District – Jashpur (C.G.) for the offence punishable under Sections 309(6), 351(1) and 310(2) of the Bharatiya Nyaya Sanhita, 2023 (BNS), be released on bail on his furnishing a personal bond with two local sureties in the like sum to the satisfaction of the court concerned with the following conditions.
