HIGH COURT OF CHHATTISGARH AT BILASPUR
Rakesh Mohan Pandey, J
PUNAM SINGH – Appellant
Versus
STATE OF CHHATTISGARH – Respondent
WPS No. 9207 of 2022
For the Appellants/Petitioners: Santosh Bharat
For the Respondents: Abhishek Singh, Vikas Shrivastava
A petition challenging a remand order becomes infructuous or unsustainable if the administrative authority has already executed said order by appointing another candidate and the petitioner fails to challenge the subsequent appointment order.
Headnote:The petitioner challenged the order dated 02.12.2022 passed by the Commissioner, which dismissed a revision against the Collector's order dated 09.11.2022. The Collector had previously cancelled the petitioner's appointment as an Anganwadi Worker and directed the Chief Executive Officer to re-examine application forms and redraw the merit list strictly in accordance with guidelines. The primary issue was whether the petitioner could be reinstated as an Anganwadi Worker despite the execution of the Collector's order. The court observed that pursuant to the order dated 09.11.2022, the selection process was completed and a third party (intervenor) was appointed to the post on 19.12.2022. The court noted that the petitioner failed to challenge this subsequent appointment order. Accordingly, this petition fails and is hereby dismissed
