Headnote:The petitioner, serving as a Hostel Superintendent, challenged an order dated 13/07/2026 whereby the charge of a Pre Metric Tribal Boys Hostel was withdrawn from the petitioner and assigned to a teacher. The petitioner contended that this action was in direct conflict with a State Government circular dated 24/02/2026 and a previous order of the court in WPS No. 4582 of 2026. The primary issue was whether the assignment of the hostel superintendent charge to a teacher was permissible given the petitioner's existing charge and the governing administrative circulars. The court observed that as an interim measure, the operation of the impugned order should be suspended to maintain the status quo. it is directed that the effect and operation of the impugned order dated 13/07/2026 shall remain stayed till the next date of hearing.

Learned senior counsel appearing for the petitioner submits that the petitioner is the Hostel Superintendent in the Govt. Post Metric Tribal Boys Hostel Pandripani, Block Farsabhar, District Jashpur, C.G. and is also having the charge of Govt. Pre Metric Tribal Boys Hostel, Pandripani, however, by the impugned order dated 13/07/2026 (Annexure P/1) one Teacher(LB) who is working at Government Middle School Kulharbuda, Block Farsabahar, District Jashpur, C.G., has been assigned the charge of Hostel Superintendent of Government Pre Metric Tribal Boys Hostel, Pandripani, Block Farsabahar, District Jashpur and the charge of the said Hostel Superintendent has been withdrawn from the present petitioner, which is in direct conflict with the circular issued by the State Government dated 24/02/2026 (Annexure P/8) and the order passed by this Court in WPS No.4582 of 2026.

Considering the submission made by learned senior counsel for the petitioner that Respondent No.4 who is a Teacher has been assigned the work of Hostel Superintendent despite the fact that the petitioner is having the said charge, hence purely as an interim measure it is directed that the effect and operation of the impugned order dated 13/07/2026 shall remain stayed till the next date of hearing.
List it on 18th of August, 2026.
