A criminal revision challenging the dismissal of a discharge application becomes infructuous once the trial concludes and the applicant is convicted.

Judgment on Board

1. At the outset, learned counsel for the applicant submits that this criminal revision was preferred by the applicant against the order dated 21/02/2018 passed by learned Special Judge (Prevention of Corruption Act) Uttar Bastar Kanker, District Kanker in Special Sessions Trial No. 01/2017 whereby application preferred by the applicant under Section 239 of CrPC for discharging the offences registered against her had been dismissed, however, during the pendency of this revision, the trial has already concluded and the applicant herein has been convicted, therefore, this criminal revision has become infructuous.

2. In view of the aforesaid submission made by learned counsel for the applicant, this criminal revision stands dismissed having become infructuous.
