ORDER

RTI-I:- CIC/PNBNK/A/2022/658041 1. The Appellant filed an RTI application dated 28.04.2022 seeking information on the following points:

(i) Photocopies of all title deeds of IPs in the name of Gurdas Garg S/o Nohar Chand Garg said to be mortgaged to bank for granting credit facilities to above said firms.

(ii) Photocopies of all valuation reports got done by bank from approved valuer of bank and valuation certificates of bank officials of my IPs said to be mortgaged to bank. (Period for which information sought from 25.07.2015 to 28.04.2022).

(iii) Photocopies copies of all legal search reports of my IPs got conducted by advocate on bank’s panel. (Period for which information sought: From 25.07.2015 to 28.04.2022).

(iv) Photocopies copies of all letters of intent, if any, signed by me for creation/continuation/extensions of charge/mortgage in favor of bank to secure the credit facilities granted to above said firms. (Period for which information sought: From 25.07.2015 to 28.04.2022).

(v) Photocopies copies of mortgage deed register showing he entry of equitable mortgage of IPs (belongs to me) by bank officials. Provide me complete details of date of mortgage of IPs and extension of charge time to time. (Period for which information sought: From 25.07.2015 to 28.04.2022).…, etc./ other related information.

2. The CPIO replied vide letter dated 03.06.2022 and the same is reproduced as under :-

“In this connection it is informed that information/documents cannot be provided as the matter is sub-judiced in DRT.”

3. Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 14.07.2022 alleging that the information provided was incomplete, false and misleading. The FAA vide order dated 23.08.2022 upheld the reply given by the CPIO.

4. Aggrieved with the FAA’s order, the Appellant approached the Commission with the instant Second Appeal dated Nil. RTI-II:- CIC/PNBNK/A/2022/658065 1. The Appellant filed an RTI application dated 28.04.2022 seeking information on the following points: <br/>

(i) Photocopies of all title deeds of IPs in the name of Sh. Saran Dass, S/o Sh.

Nohan Chand Garg said to be mortgaged to bank for granting credit facilities to above said company.

(ii) Photocopies of all valuation reports got done by bank from approved valuer of bank and valuation certificates of bank officials of my IPs said to be mortgaged to bank. (Period for which information sought from 15.04.2015 to 28.04.2022).

(iii) Photocopies copies of all legal search reports of my IPs got conducted by advocate on bank’s panel. (Period for which information sought: From 15.04.2015 to 28.04.2022).

(iv) Photocopies copies of all letters of intent, if any, signed by me for creation/continuation/extensions of charge/mortgage in favor of bank to secure the credit facilities granted to above said company. (Period for which information sought: From 15.04.2015 to 28.04.2022).

(v) Photocopies copies of mortgage deed register showing the entry of equitable mortgage of IPs (belongs to me) by bank officials. Provide me complete details of date of mortgage of IPs and extension of charge time to time. (Period for which information sought: From 15.04.2015 to 28.04.2022).…, etc./ other related information.

3. Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 14.07.2022 alleging that the information provided was incomplete, false and misleading. The FAA vide order dated 23.08.2022 upheld the reply given by the CPIO.
