1. The issue under consideration i.e. the reliefs sought by the complainant in the complaint dated 28.07.2022 due to alleged non-supply of information vide RTI application dated 30.05.2022 are as under:- (i) “To direct the CPIO to provide the information sought in the RTI application.

(ii) To take appropriate action against the erring officials for not providing the information within stipulated framework of time as prescribed under the RTI Act.

(iii) To grant compensation for the losses incurred by him due to harassment and undue delay caused by the respondent.”

2. Succinctly facts of the case are that the complainant filed an application dated 30.05.2022 under the Right to Information Act, 2005 (RTI Act) before the Central Public Information Officer (CPIO), Central Bank of India, Coimbatore, TN, seeking following information:

 Provide the following information with regard to the complaint made by the complainant with respect to the illegal actions of the Branch Manager and that of the Regional Manager cum CPIO.

1. Provide the following Information with respect to my OD on FD:

A) Date from which the FD and OD on my account no. furnished by you in the reply above referred is officially available with you.

B) Name of the account holder who is supposed to service the Interest as on your records.

C) Is there any other joint account holder with respect to FD on which 0D is taken.

D) Has the OD account holder or any other person given guarantee or authorization to debit or service interest from any other account.......... If so please provide a copy of the same.

E) The date from which is the FD pledged with you against which OD is availed by the complainant.

F) Amount of OD taken from the above FD respectively.

G) The value / amount of the FD (including interest) as on date of service of interest.

H) The way / manner in which the interest was debited from the 1't term.

I) The date the interest was due as per your records.

J) Copies of the official communication send to me with regard to service of interest and informing me on the due and final /last date, or any other information as defined in sec 2(f) of RTI Act 2005 etc.....

K) Copy of any reply received from me if any with regard to the above...

please furnish a copy of the same as available on your official records.

L) The Date which the accounts becomes NPA as per your official records, mentioned in your reply.

M) Please inform the section and sub section with regard to the account becoming NPA; Please specifically mention it only with regard an OD against FD. Also provide me a copy of the same.

2. Please provide the following information with regard to the account from which the Interest was taken / serviced with respect to the above complaint and your letter:

A) Name of the account holders and account no. from the account interest was serviced.

B) Is any of the other account holders (other than the complainant B.Premkumar) a party to the loan / OD for which interest was serviced.

C) As per your records how many times has the complainant B.Premkumar ever operated this joint account from the date of starting or as much available on your official records also given any official instruction or any communication as defined in sec 2[f) of RTI Act; please provide a copy of any if available.

D) Has the bank sought any official permission to service the interest of another loan from this account from any of the account holders If yes a copy of the same E) Has the bank received any letter / authentication from any of the account holders to service the interest from this account. If yes a copy of the same may be furnished.

3. Provide the following information with regard to the action and powers of the Bank Manager and his staff to service the Interest from another account.

A) Please mention the section with sub section empowering the Manager to debit / service interest etc. from an another account joint account where in only one party has taken a loan independently on his own capacity aga
