1. The issue under consideration arising out of the second appeal dated 16.03.2022 include non-receipt of the following information sought by the appellant through the RTI application dated 07.12.2021 and first appeal dated 26.12.2021:- (i) “Request to furnish full details with Xerox copies of action taken report and status of my One Time Settlement (01S) proposal dt. 27-11-2020 pertaining to the settlement/closure of his liability of your bank pertaining to the loan account no. ****** 0238.

(ii) Request to furnish full details with Xerox copies of action taken report and status of his One Time Settlement (UM) proposal dt. 22-12-2020 pertaining to the settlement/closure of his liability of bank pertaining to the loan account no.***** 0238.

(iii) Request to furnish full details with Xerox copies of action taken report and status of my One Time Settlement (On) proposal dt. 06-11-2020 pertaining to the settlement/closure of his liability of your bank pertaining to the loan account no.***** 00238 Please furnish me the above information within 48 hours since it is relates to his life and liberty.”

Succinctly facts of the case are that the appellant filed an application dated 07.12.2021 under the Right to Information Act, 2005 (RTI Act) before the Central Public Information Officer (CPIO), Union Bank of India, Kakinada, seeking aforesaid information. The CPIO did not give any reply. Aggrieved by the same, the appellant filed first appeal dated 26.12.2021. The First Appellate Authority (FAA) did not pass any order. The CPIO vide letter dated 07.01.2022 replied to appellant. Aggrieved by that, the appellant filed second appeal dated 16.03.2022 before the Commission which is under consideration.

3. The appellant has filed the instant appeal dated 16.03.2022 inter alia on the grounds that reply given by the CPIO was not satisfactory. The appellant requested the Commission to direct the CPIO to provide the complete information and take necessary action as per Section 20 (1) of the RTI Act.

4. The CPIO replied vide letter dated 07.01.2022 is reproduced as under:

(i) “OTS offer rejected and request, to pay full amount. Register Post with Acknowledgement sent. Acknowledgement was receives signed by K Ganikamma, Mother of Kondamuri Nagendra Prasad.”

(ii) Request Not received (iii) OTS offered is rejected and asked for improvement in the proposal. Reply sent on 20.11.2020. Acknowledgement from K Nagendra Prasad received on

24.11.2020 The FAA did not pass any order.

5. The appellant remained absent and on behalf of the respondent Ms. Rasmirekha Mohanty, Branch Manager, Union Bank of India, East Godavari attended the hearing through video conference.

5.1. The respondent while defending their case inter alia submitted that they had informed the appellant vide letter dated 07.01.2022 that his OTS proposal was rejected and he was advised to improve the proposal. Subsequently, his loan account was closed in pursuance to another OTS in 2022.

6. The Commission after adverting to the facts and circumstances of the case, hearing the respondent and perusal of records, observed that due reply was given by the CPIO on 07.01.2022. Further, in the absence of the appellant or any written objections thereof, the averments made by the respondent were taken on record. There appears to be no public interest in further prolonging the matter. Accordingly, the appeal is dismissed.
