1. The issue under consideration arising out of the second appeal dated 28.03.2022include non-receipt of the following information sought by the appellant through the RTI application dated 11.11.2021and first appeal dated17.12.2021- “(cid:1)ाथी के िपता के नाम जामा FDR No.126213,126214,126215,(cid:14)दनांक 06.05.1999ज़ारी

2. Succinctly facts of the case are that the appellant filed an application dated 11.11.2021under the Right to Information Act, 2005 (RTI Act) before the Central Public Information Officer (CPIO), Central Bank, Rajasthanseeking aforesaid information. The CPIO vide letter dated 29.11.2021replied to the appellant. Aggrievedby the same, the appellant filed first appeal dated 17.12.2021 The First Appellate Authority (FAA) vide order21.01.2022 replied to appellant and dispose of the appeal. Aggrieved bythat, the appellant filed second appeal dated 28.03.2022before the Commission which is under consideration.
3. The appellant has filed the instant appeal dated 28.03.2022inter alia on the grounds that reply given by the CPIO was not satisfactory. The appellant requested the Commission to direct the CPIO to provide the complete information and take necessary action as per Section 20 (1) of the RTI Act.
4. The CPIO replied vide letter dated 29.11.2021 and the same is reproduced as under:- (i) उपये(cid:28) िवषय पर कृपया अपने आवेदन प! (ii) आपके -ारा वांिछत सूचना कै ?म मे आपको सूिचत (cid:14)कया जाता है (cid:14)क आपके -ाया वांिछत सूचनाएआप (cid:24)वयं के खाते से संबि:धत न ढोकर (cid:14)कसी अ:य के खाते से संबि:धत ह ै अतः ढम आपको सूिचतकरते ह ै (cid:14)क आवे(cid:14)दत सूचना, सूचना अिधकार अिधिनयम 2005 कA धारा 8(1)(d) के अंतग%त वािणिBयकिवCटास व कारोबारी गोपनीयता,व धारा 8(1)(j)के अंतग%त Dि(cid:28)गत सूचना से संबि:धत है व इसकेअितFर(cid:28) “Banking Companies(Acquisition and Transfer of undertaking)ACT 1970 कA धारा 13 के अंतग%त ब(cid:18)क का यढ (cid:1)ाथिमक दाियGव है (cid:14)क वढ अपने 2ाढकH के खातH व अपने कायो◌ेवार कAगोपनीयता बनाये रखे। अतः उ(cid:28) (cid:1)ावधानH को सKान म(cid:25) लेते /ए आपको आवे(cid:14)दत सूचना उपलLध नहकरायी जा सकती ह।ै
The FAA vide order dated 21.01.2022upheld CPIO reply.
5. The appellant and on behalf of the respondent Shri AnujChitransh, Dy. Manager, Bank of Baroda, Meerut attended the hearing through video conference.
5.1. The appellant inter alia submitted that he had clearly mentioned the relationship with the account holder in the RTI application that he was son of Late Shri Krishna Nayan Khanna i.e. the deceased account holder. However, the respondent had not provided the requisite information, till the date of hearing.
5.2. The respondent while defending their case inter alia submitted that the appellant had not submitted any proof of his relationship with the deceased account holder. Therefore, they had not parted the information about third party’s account to the appellant.
6. The Commission after adverting to the facts and circumstances of the case, hearing both the parties and perusal of records, observed that the reply given by the respondent was evasive. The appellant had claimed to be the son of the deceased account holder about whom the information had been sought. The respondent claimed that the appellant had not enclosed any proof of relationship with Late Shri Krishna Nayan Khanna. In view of the above, the appellant is advised to provide copy of his father’s death certificate and copy of identity proof reflecting that he is son of Late Shri Krishna Nayan Khanna.
